2008 Troon Challenge Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The 2008 Troon Challenge Sweepstakes (“Sweepstakes”) is open only to legal residents of Arizona, California, Florida, Nevada and Texas (the “Sweepstakes Territory”), who are age 18 or older at time of entry. Employees of Troon Golf, LLC (the “Sponsor”) and Callaway Golf Sales Company, their respective parent, subsidiaries, affiliates, advertising and promotion agencies, distributors, retailers and any other individual or company involved in the development or execution of the Sweepstakes (“Promotion Parties”), and members of their immediate families (parent, child, sibling and their respective spouses) and same households, whether or not related, are not eligible to enter or win.Sweepstakes governed by U.S. law. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void outside the Sweepstakes Territory and where prohibited by law.
Sweepstakes begins on April 15, 2008 and ends on July 15, 2008 (“Promotion Period”).
There are two ways to enter:
1) On Course Entry: During the Promotion Period, purchase any Callaway Golf item at a Participating Troon Golf Property (see list below) and mail in your original receipt along with the required information listed below to: 2008 Troon Challenge Sweepstakes, 15044 N. Scottsdale Road, Suite 300, Scottsdale, Arizona 85254. Limit of one entry per person. Participating Troon Golf Properties are: Arizona: Troon North Golf Club, Talking Stick Golf Club, Whirlwind Golf Club at Wild Horse Pass and The Phoenician. California: The Westin Mission Hills Resort & Spa, Classic Club and Cache Creek Golf Club. Florida: Legacy Golf Club and Harmony Golf Preserve. Nevada: The Revere Golf Club and Badlands Golf Club. Texas: Teravista Golf Club.
2) Mail-in Entry: Mail a 3” x 5” postcard or paper with your first and last name, complete mailing address including zip code, daytime and evening phone numbers and age to: 2008 Troon Challenge Sweepstakes, 15044 N. Scottsdale Road, Suite 300, Scottsdale, Arizona 85254. Limit one entry per postmarked envelope or postcard. Limit a maximum of one entry per person. Entries must be postmarked by: July 15, 2008 and received by July 22, 2008. All entries become the sole property of the Sponsor and will not be acknowledged or returned.
For all entries: Participants must provide first and last name, a valid email address, complete address including ZIP code, daytime and evening phone numbers and age. Entries must be postmarked between April 15, 2008 and July 15, 2008 and received by July 22, 2008. All entries are subject to Troon Golf’s Privacy Policy at www.troongolf.com/company/privacy_policy.php. Post Office Box addresses will not be accepted. More than one entry per person will void all entries for said person. Photocopied, illegible, or mechanically reproduced entries are not eligible. All entries and requests become Sponsor’s property and will not be returned or acknowledged. Sponsor is not responsible for lost, late, damaged, misdirected or postage due mail/entries. Your use of any automated sweepstakes or sweepstakes entry system, or a professional sweepstakes or sweepstakes entry agent, to submit entries in the Sweepstakes is prohibited and will result in disqualification.
PRIZES: No purchase necessary. You have not yet won. Ends: July 15, 2008. Prizes & Approximate Retail Values ("ARV"): One Grand Prize consisting of entry for the eligible winner and one guest in the 2008 Troon Challenge Finals in Las Vegas, Nevada (ARV: $1700). Four First Prizes consisting of: two rounds of golf at the Troon Golf managed facility nearest to eligible winner’s residence within the Sweepstakes Territory (ARV: $500). Five Second Prizes consisting of: A one dozen box of Callaway Golf golf balls (ARV: $40). Total Approximate retail value of all prizes: $3,900. All prizes will be awarded, provided a sufficient number of qualified entries are received, and subject to acceptance and compliance to these rules by prize winners. No more than one prize will be awarded per eligible person. Prizes shall be collectively referred to in these Official Rules as “Prizes” and individually as a “Prize.” Odds of winning depend on total number of eligible entries received, estimated at 1:5,000 for any Prize. ADDITIONAL RESTRICTIONS ON GRAND PRIZE AND FIRST PRIZES: Grand Prize and First Prizes do not include travel, airfare, lodging, and other expenses. Grand Prize winner is solely responsible for all costs and expenses of winner and guest flying or traveling to and from Las Vegas, Nevada, and for all other expenses not expressly stated herein, including but not limited to meals, accommodations, gratuities, transportation, airfare, and lodging. First Prize winners are solely responsible for all costs and expenses of traveling to and from the Troon Golf managed facility nearest the winner’s residence within the Sweepstakes Territory and for all other expenses not expressly stated herein, including but not limited to meals, accommodations, gratuities and transportation. All First Prizes are subject to availability and black out periods may apply. Tee times are confirmed on a first come, first served basis, subject to each Participating Troon Golf Property’s member and guest policies. First Prizes must be used by July 31, 2009, or the unused portion of the Prize will be forfeited. Use of Prizes must be in accordance with the terms and conditions of the applicable Participating Troon Golf Property. Winners may be required to complete a W9 form.
Winners will be selected in a random drawing from all eligible entries received during the Promotion Period on or about ten days after the close of the Promotion Period. Random drawing will be conducted before 5:00 PM Eastern Time at 15044 N. Scottsdale Road, Suite 300, Scottsdale, Arizona 85254 on or about July 25, 2008 by Sponsor whose decisions are final. Winners will be notified by mail and will be required to complete and return an Affidavit of Eligibility and a Release of Liability (“Affidavit”) and where permissible a Publicity Release within 14 days of date specified on notification, or an alternate winner will be selected. Prizes awarded within 30 days after receipt of Affidavit/Release. Prizes are not redeemable for cash. Prizes are non-assignable or transferable except to a surviving spouse. No substitutions are permitted except if a prize is unavailable, in which case a prize of equal or greater value will be awarded, at Sponsor’s sole discretion. Do not enter this Sweepstakes if you do not want to win golf merchandise. Winners are responsible for all federal, state and local sales and income taxes associated with winning any prize. Any other incidental expenses on prizes not specified herein are the winners’ sole responsibility. Entry and acceptance of prize constitute permission to use each winner's name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law.All prizes are guaranteed to be awarded.
Participating entrants agree to these Official Rules and the decisions of the Sponsor, and release the Sponsor, the Promotion Parties and their affiliated companies, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance use and misuse of any prize. Winners assume all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of any prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prizes.
The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, or acting in violation of these Official Rules, as determined by Sponsor. Any attempt by any person to undermine the legitimate operation or administration of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of any other provision of these Official Rules.
Winners acknowledge that the Sponsor, the Promotion Parties and all other businesses concerned with this Sweepstakes and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of prize except that the prize shall be subject to manufacturer’s standard warranty.
Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Arizona or the appropriate Arizona State Court located in Maricopa County, Arizona U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Arizona, U.S.A. without giving effect to any choice of law or conflict of law rules (whether of the State of Arizona or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Arizona.
For a list of winners, (available after August 1, 2008), send a self-addressed, stamped envelope by November 30, 2008: 2008 Troon Challenge Sweepstakes 15044 N. Scottsdale Road, Suite 300, Scottsdale, Arizona 85254. All records shall be made available to the appropriate state authority within 30 days of receipt of any such request.
